California- my friend was pulled over for a dui the other night i am 20 i was in the passenger seat intoxicated but the sherrif let me go home without taking my name down or anything. he found my wallet in the jeep and i called the evidence room to get it back. i talked to the sherrif on the phone and he was asking me questions about the night and what happened. is this just normal procedure or is he trying to write me a ticket for drunk in public even though he didnt that night. can he even write me a ticket after he already let me go?

well shoot i already told him what happened and that i got the alcohol from my house. i hope he dosent try to get me with supplying to minors cause my friends 16 year old brother was with us and he had a few beers. so what you are saying is i should go get my wallet from evidence and not talk to him anymore and hope he dosent write me a ticket.

No, he is not going to be able to make a case for public intoxication after the fact. It won't happen. If he had wanted to arrest you that night he would have done so.

You were probably asked those questions by the property clerk or officer so that he could determine whether or no the could turn the wallet over to you. If the vehicle were towed and law enforcement does not have the wallet, you may have to talk to the tow company to find out whether they will let you come down to get it.

EDIT: Now, if you confessed to some other crime (such as providing alcohol to a minor) then that might be used against you.
