What is your state? South Carolina What is the name of your state? South Carolina My wife and and I are going through a divirce,we tried to reconcile,which did'nt work.While trying to reconcile she told me that she had a (friend) of one of the big cell phone co(s). pull my records,she knew dates details,etc. I know my rights were violated,I know my records cannot be pulled/obtained unless a judge orders it,so what should I do? Please any help from any one I'd be thankful.I want justice served to the person or persons who did this,(they knew when they did it they were breaking the law,By the way this is an "old friend of my wifes" this is a Fed,Case.FCC laws were broken and they knew what they were doing when they did it. I want legal action taken against them(the one(s) who pulled my records.I want compensation for Distress,violation of privacy,mental anguish.loss of sleep(for days at a time),should I go on ?I want their jobs(if you can't trust them,why should they hold these positions?)I want compensation and justice.Who do I go to Federally?What steps do I take?Idon't want too obtain an average lawyer.I'm considering an Dist.Att? Please help me out guys.

You can... but it won't do any good. Their conduct will not get you anything.... other than the satisfaction of filing a complaint with the FCC (if you want).

ROTFLMAO!!! Calm down before you have a stroke. Where to start??
- You do not have a compensable claim.
- You do NOT have a criminal case (for a DA).
- You have no case or claim against them.
- Let your attorney know what happened.

And guess what... accessing someone else's phone records is done all the time.... and not illegal (yet).

To add to JETEX's advice...google cell phone records and see what you get. It is not illegal. My hubby ordered his ex-wife's current husband's cell phone records for $100.00 to confirm that she was in detox again during a certain time period.(the phone records revealed that the phone had been used to dial into the hospital's psych. ward). If you don't want people to know where you're calling, whose calling you and the length of your conversations, don't use a cell phone.

Add one thing. . .

The cell phone records that are available are records contained within an already completed billing cycle. Thus if the party's cycle ends the 12 th of the month, records for the previous 30 days can only be obtained at a later date, from the already generated bill up through the 12th. So on 10th you can't just order a bill from the 8th or 9th. There must be an existing bill.
