I'm sure you're tired of seeing my post, but I really need some help on this one. After going to court on Tuesday, the judge warned my ex about violating the court order. I picked my little girl up on Wednesday for the holidays from my grandparents home, and I forgot that I was supposed to get her medicine. I text messaged her mom yesterday to see if she could meet me somewhere so that I could get the medicine, and she told me she had run out. I then returned the message asking if there were any refills, because I'd just go get it myself so she could have it. She told me no, and that I should purchase OTC medications until she gets her back to the doctor to get more refills.

I became suspicious because I have setup the walgreens online thing to email me when medication is ready for pick up, and I can also log in online and see the history because before she took her back, I was the one keeping up with it.(her medicines)

I checked my email, and it showed that she picked her 3 different medications up on 2 recent but different dates, and ALL 3 of them are at least 30 days supplies if given daily, but there are 2 that she is supposed to take as needed. She picked them up on the 13th, and 17th of this month. There is NO way she's run out this quickly unless she's selling it, or giving WAY more than the prescribed dosage. One medication that concerns me the most is the one she's supposed to be taking everyday. The others bother me, but not as much as this one. My daughter has this ailment that causes her tonsils to swell to the point where she can't swallow, and cannot breathe through her mouth. It makes her miserable, especially when this is accompanied by chest and nasal congestion, and a horrid cough.

I decided to call walgreens and check if they had refills on the medication available, which they did, so I just filled them all and picked them up yesterday. She was already starting to feel bad after only 1 day of not having taken her medications, and her mom knows that. I wouldn't be bothered by this if it was somethign that was directly affecting me only, but this is my baby suffering because her mother is trying to frustrate and upset me. Not only that, but this is the THIRD time she has done this to me as well when I've asked for her medication where she's had it, just won;t give it to me.

I don't know if this is something CPS would touch, but I need to know all the alternatives I have to make certain that this doesn't continue.

I also need to know what to do about the medication I have. If she is claiming to have run out, which I don't believe, I feel that I should send the medicine when I return my daughter. But I have a big part of me saying no, and to keep it because I need to make sure that she has it when I exercise my visitation rights since her mom won't give it to me. What should I do?

What kind of medication is it? Its probably not a problem since you were able to get refills so soon after mom did, however, sometimes a doctor won't re-prescribe some medications within a certain number of days since the last prescription. If that's the case, and you keep the meds, mom might not be able to get what the child needs once the meds she has run out.

I would better recommend that you keep only what you need to cover your parenting time for the period that the original prescription and the refills were to cover.

What I did in a similar situation was call the doctor and explain the situation, and request duplicate scrip's. Then I got them filled separately and kept them at my house for just such problems. No fuss, no muss...

If you do this, you have to make sure that the doctor notifies you about ANY changes to the meds, so that you can keep up, and also to avoid any bad drug interactions.

I would also keep those text messages along with the online information showing the dates she last picked them up for future reference.

I doubt the court will look kindly on playing games with a child's medication.
 
The medications that she's taking are Singulair, Zyrtec, and Z-Cof. The Singulair is the only one taken on a daily basis, the others are given as needed. I was surprised that I was able to get those refills the way that I did too.

I was thinking that I should just keep what I needed and send the rest with her to her mom's house. Sounds good to me. Thanks a lot!

That's a really good idea! I never even thought of that. I'm going to look into that right now.
