Hello, hopefully someone can help me out here today. I have a problem with my ex. He has signed up for welfare using our child but the child has been living with me for the better part of the year and last year. The child only went to his father's on the weekends until school let out now we alternate weeks. I recently found out he had signed up for these programs because I was served a paper saying I needed to provide medical insurance for my child by the cabinet for family services on behalf of my ex. He has been collecting these benefits since last year all while the child was living with me. Custody has not been established, we thought it better to keep the courts out of this but after finding this out I'm not sure what to do. Is this something I can get taken care of at the Court Clerks office or is there another way to go about handling this? Thank you for any input.

Sorry, right. I just don't think its right that he gets the benefits of the child when the child has been living with me. A child is not something you use to get you by in life. I want to know how to get him to stop receiving benefits on a child that does not live with him full time.

You need to file to establish custody in court...you also need to let the welfare agency know that the child primarily resides with you.

as LDiJ said: notify the welfare department he is obtaining benefits from and inform them the child resides with you a majority of the time.

realize that not living with him full time (actually 1/2 time at the moment) is not necessarily going to disqualify him. The welfare agency is going to look at all the information when making a decision.

My ex tried that while we were still married. I found out because the agency contacted me and wanted my SSN and place of employment to begin garnishment to reimburse the state. He did this not once, but 3 separate times. Were you contacted by the state?

They just mailed me a paper that said I had 90 days to get medical insurance on my child or they would take action, I'm guessing that means garnishing my wages. I'm not working at the moment, but am looking for a job.
