Approx 4 to 5 months ago husband had went into surgery for multi hernias, this occuring after months of waiting due to having 2 surgeons fail to do surgery despite all tests and pre op screens being passed both times and waiting months for each surgeon to do surgery, .and nearly a year of stalling by surgical dept. due to their offices internal issues, neither surgeon operated. A third surgeon finally did operate. However he did not repair all the hernias, In fact ,he only repaired a few. Remarking when he come out of the operating room,"he had more than one" , my husband had close to a dozen and this was known from start and visible in every scan my husband had...now months later he still has hernias that protrude from his abdomen..the surgeons response has been that his stitches healed well..my husband continues to suffer in pain which they will only give Tylenol for. No one should have to suffer in this way because a surgeon failed to look at the results of imaging that was done repeatedly, which by the way insurance failed to cover 2 times because the surgery was not performed those times. This can kill him and was due to the surgery dept.s failure of providing the necessary care and not repairing his hernias as they knowingly knew was needed..so his health continues to remain at risk, and he is in constant pain that gets worse as each day passes..What can we do about the failure of the surgery dept. and the surgeon that operated on him and failed to study the scans and images or previous results and notices of record resulting from all the tests and scans,imaging,etc as to what he was suppose to do...even to the point of not knowing that my husband had numerous hernias protruding from his abdomen that was easily seen with his clothing on,they protruded out by several inches making him appear deformed....This was negligence on the surgeons part. as well as the dept he runs.....all the information needed was easily available to him prior to surgery....help us please...

Surgeons cannot always repair all hernias or repair all hernias successfully. This is more often the case when a patient suffers from multiple hernias.

But your husband can take his medical records to a medical-malpractice attorney for a personal review. Initial consultations with med-mal attorneys are generally free.

Before you can even begin to think of filing a malpractice suit, you need to take your husband to another specialist (doctor) to look at his case.

This will help you determine what further can be done (medically) for your husband, as well as establish what, if anything, could and should have been done differently.

A med-mal attorney will want another surgeon's opinion on the previous surgery so I agree that can be the best first step.

Because three surgeons reportedly have reviewed the scans and the third surgeon did not repair all hernias found during the single surgery, there could very well have been complicating factors present with the patient that precluded further repair at that time.

A personal review of the medical procedure, the medical records and the patient's history are necessary to determine if there was any malpractice.
