hi. i've been here before and have a question.

my husband has sole custody of his two kids from a previous marriage. the bio mom has been on supervised visits for 7 years. my husband's divorce papers say (i quote) "the mother shall have supervised visitation only".

my husband was allowing his ex-wife's mother to be the "supervisor" of the visitation until so many ill comments were made by his ex and his ex-mom-in-law about me and my husband that he has since re-routed the visits to a child visitation supervisory facility. also, one child is in counseling (due to issues of abandonment and depression: bio mom walked out when one child was 3 yrs. old and the other only 10 months old) and the counselor sent a letter to our attorney stating that the "biological mother and maternal grandmother undermine the relationship between the child and the step-mother and are an emotional and mental liability for the child on other levels". even so, the bio mom and her family told my step-kids that they "will not be supervised by strangers at any facility" in order to excersize visitation. the bio mom, in phone calls to the children, keeps stating she is going to take my husband to court in order to "get unsupervised visits at her house". the bio mom has another child out of wedlock, which i'm told is considered "questionable moral character" in the eyes of the court and is over $25,000.00 behind in child support although she has begun to make regular payments now.

here are my questions:

1. does the bio mom have a chance at getting unsupervised visits after a counelor has made as strong a statement as she did to our attorney about the bio mom being a "liability"?

2. does the duration of the supervised visits benefit my husband? to be more precise, since the bio mom has been on supervised visits for 7 years and never once made an attempt to seek a court order for anything else, is is safe to assume that looks bad on her?

3. since she is so far behind in child support, does that even matter since she is now paying on a steady basis?

4. will the fact that bio mom is willfuly refusing to visit the kids look bad on her in court if she goes in there to complain about the supervised visitation?

Yes. How much of a chance depends on the facts of the case and the court.

No, those are simply facts. They will have to be evaluated along with all other 'facts' of the case but in no way determine the final ruling.
