hi i live in the state of ca.

i need to no what chapter of bankruptcy me and my husband need to file we are in serious debt due to child support,so all our other bills have gone to collections or are on there way, except we want to keep are car and we still owe quit a bit on it. but it is the only one we have.

do you have to qualify to file bankruptcy? we both work, i bring home around $1430 after taxes mthly husband $1200 after taxes and $700 mthly in child support.

are car pymt is $441 ins$95 rent $680 that leaves us with less than $1500 a mth for food pg&e phone and we have three kids.

any info is greatly appreciated :)

You should see a lawyer about the best option for your situation. Personally, I think a chapter 7 would be approiate but, it all depends on what sort of debt you have and what assets you own.
