I need some legal advice on these 3 scenarios.
1. Seller offers to sell Buyer a boat for $500. Buyer replies, “I think I want the boat, but let me have a week to consider.” Seller says “OK. I will not sell the boat to anyone until after one week from today.” The very next day, Seller sells the same boat to Popeye for $600. The day after that Seller calls the Buyer and tells her that Seller has already sold the boat. Nevertheless, Buyer shows up within the week and gives $500 to Seller within the week .
Is the Seller contractually liable to Buyer?
Do they have a contract? Can someone please explain all the arguments the Buyer can make to claim a contract exists and then explain all the arguments that the Seller can claim that a contract does not exist.
2. Lisa mails Mickey an offer. Mickey drafts an acceptance but then decides not to accept. Later Mickey accidentally mails the letter of acceptance together with other letters. Is there a contract? Why or why not. What are any or all the reasons as if there is a contract or not?
3. Seller wrote a general email to ten buyers asking “do you want to buy 240 cattle each at 1000 pounds (per cattle) at $8.25 per pound?
Cattle Must be sold by Friday. Phone me at Wichita Kansas if you accept.”
One buyer faxes an immediate acceptance saying: "I accept all 250 cattle!" Is there a contract why or why not. What are any or all the reasons?
