It's a crime to take things that don't belong to you in any state. The question is who was the rightful owner of the remains. Who took them?

Are you saying your ex-boyfriend took them? Well, report it to the police. Absent knowing the all the relationships to the deceased, I suspect that the ashes likely belong to the children, not you or your ex.

There could be a crime besides theft that could be charged depending on why the ex-boyfriend took the cremains and what the ex-boyfriend does with them, or intends to do with them.
