What is the name of your state (only U.S. law)? TX
My daughter has struggled with school from day one. The things that other children learned with ease, she took hours to learn. Homework has always been torture. But we do what we have to do. When she was in 1st grade, her teacher talked about holding her back, but then ended up sending her to 2nd grade. At the beginning of her 2nd grade year, we moved to another school. Her new teacher expressed her concern with my daughters ability and we in turn put her back in 1st grade. She continued to struggle for the next few years. When she was in 4th grade (2004) I started pushing a little harder to find out what was wrong. My daughter had told me that letters were fading in and out on the paper. I imediately thought dyslexia. I asked for dyslexia testing to be done in order to rule it out. At that time the school did special education testing and I thought dyslexia testing. During the ARD they went over the results for the special education testing and explained she did not qualify. They also told me she was NOT dyslexic. I trusted their findings and we just accepted that school was going to be hard for her and we would help her however we could.
My daughter is now a Sophmore in High School in a different school district. And I am now a dyslexia teacher in the same district at a different school. After I completed my training in dyslexia I realized that my daughter fit the profile for dyslexia. I then requested dyslexia testing on my daughter. It has shown that she is SEVERELY dyslexic. This made me a bit furious with the previous district. My husband went and got copies of the testing administered to my daughter in 4th grade. THERE IS NO DYSLEXIA TESTING!! AND, the notes from the diagnostician on her F.I.E. states that she has a deficit in phonological awareness and would benefit from a phonics program (DYSLEXIA). I have since been told that being that my daughter has an above average I.Q. she would have been VERY successful in school if she had been given the tools to succeed (dyslexia classes). As a mother, I feel at a loss for words that my daughter has lost ALL this time.
My question is, has my daughter experienced a disservice from the previous school district? What can I do? What are my rights? HELP!! What is the name of your state (only U.S. law)?
