i live in kentucky. my ex husband has visitation rights and one night i got a call at 1am and my ex went to jail for hitting his girlfriend (infront of my girls) while drinking and i of course went to pick them up and he now has an epo on him from that girl. can i file child endangerment charges or what can i do because now they are back together (he's a bad fathter).

I live in Indiana. My ex husband was living with a woman in Michigan and was put in jail for a month over a domestic assualt on her. I wasn't there, I don' t know the whole story but obviously there was evidence. I called my lawyer and asked him if because of this I could have visitation modified or stopped. (by other posts you would see why). I was informed that I couldn't because the incident didn't involve my children and even if they were there as long as he didn't touch them I couldn't do anything. I'm just thankful that he'd missed visitation. My boys were supposed to be there at that time but he didn't come and get them. I would of had to drive 7 hours to get to them and who knows what would of happened to them before I got there. You need to check with your lawyer(or any lawyer) and see if it's grounds to modify visitation.

Obviously you should talk to an attorney, but since your kids were actually there and witnessed the assualt, then yes, I would think that could be considered child endangerment. Plus, comitting illegal or immoral acts in front of the children can also be grounds for visitation modification. Be prepared that he will probably still get supervised visits tho.
