I live in NM. I have sole custody of 2 children from my first marriage. I recently got married again. My husband will be receiving orders to move to Germany. The move is to take place in Jan 2002.

I have looked in my divorce decree and nowhere does it state that I need to notify the kids father of this. I was wondering if anybody knew the time frame of when I need to send him a certified letter?

He moved to the east coast in April 1997 because his girlfriend was moving there. We did not have the visitation legally modified, we did write up a statment and both sign it stating he would have the kids for 1 1/2 months every summer. He has yet to see them since he left, I even offered to purchase the airline tickets myself because of what it was doing to the kids, both times he said no.

Any advice would be appreciated, I don't want any problems to affect the kids so I want to make sure I get everything in order now. Thank You. p.s. I have talked about this move and what it means with the kids in detail, they want to go.

You need to inform him of your intention to move ahead of time. I do not know how long for an international move, but for stateside moves, most states say 30 days. It is then up to the NCP to petition to stop the move in that time.

I would suggest you get a one time consultation with an attorney.
