Thank you for the response but I'm not asking because I received a notice personally (I own my home). A friend asked if I knew what it meant...

Are you sure it reads does NOT elect to declare...
This is how it usually reads

YOU ARE FURTHER NOTIFIED THAT if you do not comply with either of the above the undersigned does hereby elect to declare the forfeiture of your lease or rental agreement under which you hold possession of the above-described premises and lessor will institute legal proceedings to recover rent and possession of said premises.


And as that IAAL "person" says, it means the landlord is adjusting his boot straps ...

Yes it states "NOT to elect forfeiture" as well as "This notice is given pursuant to section 1161 of the CA Code of Civil Procedures".

Like I said I am just curious as to what that paragraph meant - I have taken some courses in law but nothing yet on real estate law. I have seen other three day notices that state what you wrote in your reply but nothing like this before.

Well it means your friend's landlord is a wishy-washy Charlie Browne kinda guy or got the wrong forms form thea tenant friendly gaslight forum... :confused:
