What exactly is a libel/slander/defamation case worth your time?

Hi, I've been reading through a LOT of posts on this forum and it seems like almost every post that is made where the person asks a question, particularly those related to ebay or internet libel, get an insulting/rude/degrading response effectively stating the poster is an idiot and the question is not worth your time to answer.

What the hell kind of place is this? If you don't have time to answer the person's question, why bother answering at all?

Perhaps you may want to consider a FAQ or Sticky that defines exactly what consitutes libel, slander and defamation, and what types of cases you consider worthy of addressing.

Its obvious that free advice here is worth exactly what you pay for it, even less if you take into account the insults.

The problem that so often develops is a person who hears or sees something about him that he doesn't like. Rather than dealing appropriately with his hurt feelings, he wants to sue.

Defamation! Is the title of the post. He's a dirty liar! Is what the body contains. Being intelligent, rather than posting right away they usually look up the definition first. They find a false and defamatory statement made to a third party that causes damages (Not always, (Libel or slander per se) I'm not giving a lecture here.) as the definition of defamation. Open and shut. Case closed. Give me my money.

Wiser heads start telling the poster that going through the process is a big ol' darn deal and, at the end of the process, the person defamed is out money and the person defaming is still saying things. The reason for this is *damages*.

The key question is not whether a tort has been committed, but how much the person was hurt. (Let alone the proof issue or if the person defaming has a defense.) Even when damages are presumed, you tend to not get huge judgments when someone calls you a dirty rotten crook on e-bay--unless that ruins your multi-million dollar business. And, proving that is something for professionals as there is some fancy accounting involved.

So, posters continue to want to sue because their panties are in a bunch and list members continue to tell them to pull the wedgie out themselves and move on down the road as the court system is not designed for righting the wrong of daily annoyances.

Upon reading this, the person who posted is doubly outraged because now they've not only been called a crook by someone, but also an overly sensitive baby-type crook. As the final creshendo of this symphony, the person then calls the list worthless and leaves in a peak of annoyance. Not because the advice was wrong, but because the advice was not what was wanted.

The list then calls the person names and the circle of life is complete.

(My Response) Nice reply but the person is not annoyed because he didn't get the answer he wanted. He is annoyed because all he got no answer and was called an idiot. Most people first come to this site because someone either said they were going to sue or they want to sue somebody and they don't know thier rights. They may not be able to afford a lawyer for just getting a little insight on whether or not there is a bonifide case, so they just want to see if they can find some free advice. WOW, seems like I have heard that name before. So anyways they go to google and type in Free Legal Advice and up pops this forum. He thinks great, finally maybe someone can help me by answering a few simple questions. Then I can determine if I need a lawyer or not. So he joins the forum and posts his question describing a situation regarding libel etc... and what does he get? Let's be fair. Some will answer and be helpful but quite alot slam him and call him a idiot. Hey, I suppose it's just the circle of life. After all, this site is not called www.FreeHelpfulLegalAdvice.com is it? It's called just plain ol' Free Advice and it most likely should be called FreeOpinions.com. Well, here's some FreeAdvice, err I mean FreeOpinion. For all of you who want to call a person an Idiot for asking a simple question :p involving a legal issue, well your all a bunch of idiots. And if you try to respond back with something I don't like, I just gonna hit the ******IGNORE**** button. Wow, I'm sorry it's that circle of life thing again.

The OP stated that if anyone had the authority to cancel his membership, please do so.

I do not have that authority, so I chose the ignore button. Nothing rude about that.
(circle of life and all, ya know....)

:eek: OMG! you didn't read the TOS which directed you to the expert prepared law facts? Did you try clicking on the tab at the top [LAW] or the one just below [LAW TOPICS] ?
