What is the name of your state?ca
my husband has a child by another woman that lives 250 miles away from us ... we only get the child one weekend a month , we want to take her back to mediation but we are not sure what forms to file , or do we need an attorney to that ... ive done some research .... and we dont need to have an attorney acompany us to mediation i just dont know what form to file .....

we want one weekend a month from fri/ sun every other holiday every other birthday and so one

What you'd like for a visitation schedule is fair and common...You can file visitation of custody/modification through the courts. Inn CA any contested custody/visitation issues are ordered to mediation...attorney's do not attend mediation, just the parties involved.

Go to the Law Facilitator at the court and get the appropriate modification packet. Make sure you also get a form which outlines proof of service, so you can be sure you serve the mother properly. (It's simple in CA) Make 3 copies of everything (1 for you, 1 for the court which you'll file after you fill it out and 1 copy to be served on the mother). You'll be given a court date where you address your desire to be more involved in the child's life and have a standard visitation order implimented.

my understanding is that if u have been to mediation that you can go to the mediators office, set up a date, contact the other party about what the date is and thats it. however, the other party has to confirm with the mediators office that they will be present. thats how it was done in my case, the judge always wannts to see the parents try to resolve it first so it doesn't take up valuable time on the judges calender
