Hello:

I was just curious of the experiences of those who were arrested and taken to jail the night of their DUI/DWI (preferably those with a 1st offense). Were you held in a holding cell for a period of time? If you had to use the restroom, did someone escort you? Were your fingerprints taken or a mug shot? I'm just curious how others were treated. Also, for those with a first offense who have already been to court, what was the experience like and what punishment was given you?

**A: yes, a period of a long long time. Now I know why it's called a holding cell. When you want to go the the restroom they ignore you and you have to keep holding and holding.

**A: sorry, it was not my first offense so I really don't know.

**A: Only until my bail posted and a friend picked me up. About 4 hours.

**A: No. I was allowed to use the restroom while I was being processed before going in to the holding cell. They also let everyone out for 1/2hr. increments to watch TV and also use the can if needed.

**A: It was Administrative court and I enrolled in the diversion program. Easy.

my experiance

I once was pulled over when driving with a friend Halloween I think (cant remember).... anyways It was not one of my best moments. I was being stupid driving with my friend at night (no other cars anywhere) and I intentionally ran a red light...yes intentionally (don’t ask lol)...I had maybe 4-5 miller lights at one bar we were on the way to another (mistake).

I had a fake ID, a double bladed knife taped to a stick, kind of like a little spear...(and that’s a long story in itself), I ran a red light (without breaking), I had an old cooler with empty beer cans from several months before....Charges were pos fake ID, conceled weapon, DUI, reckless driving...

Long story short I thought I was screwed major.... I took and failed the road tests. My friend ended up joining me in the back of the cop car and we were off to jail...

The first thing they did was take us to another room for a more accurate breath test... I was not allowed to go to the bathroom (I had to pee so bad it hurt). I kept saying "can someone please take me to the bathroom?"...I was begging and they kept telling me "no"...an old timer next to me (45-50) said "they wont let you" I looked at him and he just pissed his pants and it was on the chair the floor ext ext...

After a long time we (my friend and I) were walked out to a large garage at the police station. The cop told me to turn around and he took off my cuffs...I was free to go right then and there...I had to pick up my friend from jail in the morning...to this day I am not sure why I got to go free but I am not complaining.... I will say this my friend was being a fool and mouthing off...

When I went to court I got all charges dropped....It seems that in Virginia they have a law that states a person can not be in restraints (hand cuffs) for longer then a certain period of time (I think it was 2 hours). My lawyer argued that from the time indicated on the road side breath test/arrest warrants/tickets whatever you want to call them, to the time I received my more formal breath test printout that 2 and a half hours had passed (all the while I was in handcuffs behind my back)...thank goodness for a inefficient system!...but wait the first thing I did after he undid my handcuffs and told me to exit the garage (kept my friend)...I walked out of the garage and walked into the jail (3am) the guy at the counter was like "WTF" lol...I said "I need to use the bathroom RIGHT NOW!". I went to the bathroom and as luck would have it the jail was next to a local bar that an old friend worked at (my car was towed during the incident) I walked down the street knocked on the door and was like "Hey I got arrested, my car was towed and our friend is in jail can you give me a ride home?"...got a ride home stoped at tacobell:)

NEEDLESS TO SAY I Have reformed my ways, but I still get a smile thinking of that night even as bad as it was:)

Here are some hints on appearing in court:

Dress professionally in clean clothes.

Do not wear message shirts.

Don't chew gum, smoke, or eat.

Bathe and wash your hair.

Go to court beforehand some day before you actually have to go to watch how things go.

Speak politely and deferentially. If you argue or dispute something, do it professionally and without emotion.

Ask the court clerk who you talk to about a diversion (meaning you want to plead to a different, lesser charge), if applicable in your situation.


Here are five stories that criminal court judges hear the most (and I suggest you do not use them or variations of them):

1. I’ve been saved! (This is not religion specific; folks from all kinds of religious backgrounds use this one.)

2. My girlfriend/mother/sister/daughter is pregnant/sick/dying/dead/crippled and needs my help.

3. I’ve got a job in [name a state five hundred miles away].

4. This is the first time I ever did this.

5. You’ve got the wrong guy. (A variation of this one is the phantom defendant story: “It wasn’t me driving, it was a hitchhiker I picked up. He wrecked the car, drug me behind the wheel then took off.”)
