What if malice is obvious and statements are made that are accurate but misconstrued to make it appear one has done something wrong when one has not? Statements designed to impugn one's reputation with one's peers in a personnel action at a state university?

You need to provide more info. Is this something that has to do with an employer/employee relationship? What do you mean by "malice is obvious"? Can you explain a bit more please?
