Greetings from Mississippi!!! I have a close friend that has recently filed for divorce citing adultery as grounds. She is seeking half of all marital property. He has vowed on more than one occasion that he will burn the house to the ground before he allows her to get it or any money from the sale of it. We definatley believe that he is capable of doing so... if he decides that is what he wants to do. The question is: If he is stupid enough to do so and is convicted of arson, how will the insurance company handle the situation? Do they not pay at all or do they pay off the loan to the bank? If they don't pay at all, is she going to be stuck having to pay for a house that no longer exists? If they do pay,is she entitled to whatever portion she would have received in the divorce or does she just lose all the way around due to his actions? Thanks for your time and assistance.

Your question, while couched in a divorce situation, is however, better suited for the Insurance Law Board.
