What is the name of your state? NY
I am thinking ahead for my Small Claims Court.
When the court awards me the judgement (and the associative payments) and assesses debtor's assets and his ability to pay, if the guy has no assets and no paycheque (no garnishments)-- he's a students and lives on student loans, what can I do then? Wait a couple of years for him to graduate or what? I would like this money now.

You'd like this money now? Hey, I'd like to have the exact same cosmetic surgery that gave Arnold Schwarzenegger his fake chin. But that ain't gonna happen, either. Honestly, it sounds like you're going to have to face the likely fact you're never going to get paid, and move on.

The court will NOT order payments. The court will hear the issues and determine what, if any, damages you incurred and whether the defendant is liable for them. If so, then you will get a judgment that will remain valid for 20 years (in NY).

If you 'want the money NOW', try to get on Judge Judy or one of the similar other 'court' shows. The judgment is paid from the shows compensation.
