What is the name of your state (only U.S. law)? Calif.

If abunch of people are laid off, do they call you back by seniority or can they call back whoever they feel does a better job?

Well its not me, the question is for a friend. She was told they were gonna have to lay some people off for awhile. She does a better job and works harder then other people that have been there longer. So her best bet is to talk to her rep?

since you posted this in the union topic, I would suspect you are in a union shop. If so, refer to your union contract for the answer. If it does not state there are recall rights or how they are to be dealt with, then you have no recall rights. As such, the employer can call back whoever they want in whatever order they want.

There are no laws whatsoever dictating when, in what order, or even whether, a laid off employee must be paid back.

If there is a union or other legally binding contract that does have such an order, then the contract/CBA would apply. If there is such a contract or CBA, we have not read it; therefore we cannot tell what, if any, order is mandated.

If there is no union or other contract specifying how a laid off employee is called back, then it's entirely up to the employer whether or not to call back laid off employees at all, and if so, under what terms or in which order.
