I wrote earlier about my husband filing contempt of court against the CP. She is denying visitation and refusing all phone calls. It has been almost two months since he had any visitation. There was no particular reason. The CP does this often. Especially around Holidays. We have never had his daughter on Easter or for Christmas. He just got a letter stating he has a hearing for a dispositional review. Just wanted to know what this is and what he should expect during the hearing? Also, is this something that the court requests or was it filed by the CP? Thanks for any advice!
 


I thought that a dispositional review was a status conference? Is there an existing case/order? Who has custody of the child? It's my understanding that a dispositional review would take place to determine if a child should be taken out of the custody of the parent who has custody. It would be strange for her to file something like that.

There is an order for visitation. The mother has physical custody of the child. It would be nice for my husband to be able to seek custody of his daughter during this hearing. That way he knows his child would be well taken care of emotionally and physically. There are serious issues, well atleast I think, that would be taken care of. Not having to give the child a bath when she comes over because she smells bad, not having to see her in her best outfit that hasn't fit for months, but she wore it to school that day. We have never seen her in an outfit that fit. Except at our house. The mother gets a check every month. Where does it go? No unexplained bruises, etc....... Not to mention her mother wouldn't be able to tell her again that she would never see her Dad or his family again. The list goes on and on. Does this sound like anything that a judge would consider to change custody to the father? She has her own room at our house. So that wouldn't be an issue. It would be in the best interest of the child. Thanks! :)
 
I don't know exactly what a dispositional review is, but I believe as the other poster does that it is to determine placement of the child. It is unlikely Mom filed this herself, but it is possible it was filed by child protective services. They may have been called by a neighbor, teacher, anyone who believes your daughter is being abused or neglected, which IMO, would be an easy conclusion to come to if the child is so dirty she smells, wears ill-fitting clothing, and has unexplained bruises!

Just a thought...does your husband even know the whereabouts of his ex-wife/daughter? If not, it is possible something has happened to Mom and because of that, the child was placed in foster care until family could be located. Is that a possiblity? It could be anything...illness, injury, even incarceration.

Who sent him the letter? Ex-wife's attorney? Government agency? That might help us to formulate an answer.

My husband knows where his child lives with her mother. I doubt they have moved. The county Family Court sent the letter. It hurts to even think that something terrible has happened for the child to be placed in Foster Care. Why wouldn't they have called us? The Family Court has our phone number and so does the mother & step father. This is really starting to concern me. :(
