What is the name of your state?TN. I spoke with my attorney's paralegal this morning and they are filing a motion of just cause and a motion of psychiatric evaluation for my two children. Can anyone please tell me what a motion of just cause is? Thanks for the help.

IAAL- I realize that I should have asked what the motion of just cause was. The only thing I can think about right now is that my ex is in contempt for two different violations regarding our divorce decree. The first is visitation violation and the second is the discipline he is using. Would that be why he is filing the motion for just cause?
 
just cause

Cause that a person of ordinary intelligence would consider a fair and reasonable justification for an act -- used esp. in cases involving termination of employment and denial of unemployment benefits

I've had my atty file motions to "Show Cause" never "Just Cause".

This might help or be totally wrong.

Motion to Show Cause:

The Motion to Show Cause is a motion filed with the court demanding that the parties appear and provide the reason that he or she has not complied with the court order. The obligor is ordered to appear before the court to show cause why he or she should not be found in contempt. The motion is a request that can be for any issue in the court order, e.g. failure to provide medical cards, insurance information, genetic testing, or for lack of support payments. The motion can cover whatever issues were not complied with in the court order. The obligor may purge the civil contempt by complying with the order. Continued failure to comply with the order or repeated findings of contempt can result in incarceration.

bononos-thank you very much. My attorney just faxed over the papers and it states that they are showing cause (I don't think that my attorney's paralegal said it right because she said just cause) that my ex is in contempt for discipline and visitation violations. He is also filing a motion for psychological counseling for our children and parties involved.
