What is the name of your state? What is the name of your state? What is the name of your state? What is the name of your state? I live in Minnesota.
I have a storage unit in Colorado. The check I sent in for payment last month didn't clear. I was sent a bill with the fee's I would owe because the fund were not available in my checking acct. I have no problem with this, what I have a problem with is that, on the envelope that my bill was sent in (through the US mail), the party who mailed it wrote "INSUFFICENT FUNDS" in red felt tip on the front of the envelope. I have never seen a business, collection agency or any of that ilk do something that tacky and demeaning. Isn't this a violation of privacy? What right has any company, large or small have to put private business out for public display?

To the best of my knowledge, this is not illegal. Tacky, perhaps, but not illegal. If I'm wrong, I'm sure someone will tell me.

I can tell you for certain, however, that one thing this is not, is any form of defamation. That occurs when FALSE information is broadcast to an audience and you suffer damages as a result. The information was not false and other than a little embarrassment, you suffered no damages.

Actually, I think it's pretty kewl :D I bet next time you'll make sure there is money in your account to cover checks that you write.

As for Illegal, forget it. You have no case at all and you're lucky the letter wasn't from the District Attorney's office charging you with passing bad checks.

**A: they stole my idea. I write "BAD CHECK INSIDE" on the envelope which is bigger than legal size. And rather than address the person with Mr., I use the word Deadbeat. Ex. Deadbeat John Doe.
