What is the name of your state?Anywhere, USA
I am posting this here because of a child custody case about to commence. What is the legal purpose of a "Memorandum In Support"?

I've looked and looked and haven't been able to find out it's actually legal purpose.

Could someone simply say whatever they want (calling other parent names, making libelous statements, misrepresentations of the truth) in it or does it have to contain actual facts, citations of law, etc.?

An ex has been using...err, I mean abusing these and thinking she can say what she wants, with no consequences (even though I am writing up interrogatories to give to my attorney for her to provide documented evidence to support her libelous statements). I responded to one once, but then stopped because what she writes in them alone SHOULD show the Judge all she is doing is acting like she's 10. In my opinion, this is misuse of the legal process and can be used against her for several factors in a custody hearing.

What is the legal purpose of a "Memorandum In Support"? Thanks.

Your state is relevant to the potential answer....you should have responded accurately to that question.

Sorry. I thought that the legal purpose of a "Memorandum In Support" is the same, regardless of state. In this case, it's Ohio, since they would have jurisdiction.

Ummm...ok then. State's been given and nothing? :confused: I highly doubt which state had anything to do with the answer I was looking for as I highly doubt its' purpose varies from state-to-state. :rolleyes:

Legal terminology can vary significantly from state to state. Therefore yes, knowing the name of the state can make a great deal of difference.

I personally don't know what that phrase means in your particular state, and did not have the time to go research it. I was hoping that once you identified your state that someone else would have that answer for you.
Doing a google search, or searching your state government website might give you the answer that you need.

In some areas that would be a supporting document to a motion or petition to the courts.
