What is the name of your state? MICHIGAN

Landlord sold house that my brother has been living in. He has been the caretaker/tenant. We are in process of moving, still have to move farm tools, equipment, etc.that belonged to our step-father and passed down to brother after his death.
My brother has summons to appear in court on Monday as part of the eviction process. We are going to court only to get more time to move.

The realtor says "closing" is today and buyer will have full possession.
My question is, can the new owner take my brother's possessions that are in the barn & garage? Are they protected under the landlord/tenant eviction process too??

I am not an Attorney, I joined this morning to post a question myself. That being said, If I were in your situation, I would speak directly with the new owners and try to make arrangements to remove your equipment within an agreed timeframe. I doubt they will want your old farm equipment.

First, I am not an attorney either.

Now to your problem. Your possessions are your possessions. If they belong to the actual owner of the house, they are not your possessions. Is the LL claiming them??

Is there any lease? if so, what is the duration of the lease?

Very simply put, the buyer does not get your possessions. You will need to remove them. How long you have depends upon your lease and eviction proceedings.

Is this your first time to court for the eviction? Have you been served anything by either the LL or the court?

The buyer cannot have full possession until you have been formally evicted, if necessary (be aware, this will cost you $$ if you insist on forcing the LL to evict you through the courts.)

CLASSIEM: it would be to your benefit to keep your posts together. They do relate to each other and the info in each of them is germane to each of the others. As well, many of your posts appear to be restatements of a previous post. If they are together they make more sense to those willing to respond.

When anybody posts an answer to your post, it takes it to the top so that is no excuse either.
