I own a home on the St. Croix River in MN and am presently leasing it out. I share a dock with 8 other neighbors and have included my slip with my lease. The neighbors have been giving my tenants a very rough time and have harassed them about using the dock. In the Association agreement there is a short statement that says, "no stockholder may rent, lease, or allow use of a slip or the common area."

My interpretation is that I am unable to lease or rent my slip. It does not say I cannot lease my property which incudes my slip. I have heard there is something called "quiet enjoyment", my tenants have a right to this and I a have a right to stop my neighbors from harassing them.

What is your advice, short of hiring an attorney?

READ it word for word.

You cannot allow ANYONE BUT YOU TO USE THE SLIP or the common areas...

The boat slip is off limits to tenants.

So the tenants can sue you for overcharing them (including the slip when you are not allowed to)and for not being truthful about the lease terms..

OR they can break the lease and it will be without penalty.
