What is Servitude and Easement of Necessity?

A "servitude" is a restriction in a covenant, or a restrictive covenant, in a deed.
An "easement of necessity" - - the easement is reasonably necessary to the use and benefit of the dominant tenement. [See Ca Civil § 2204; Tusher v. Gabrielsen (1998) 68 Cal.App.4th 131, 141, 144-145, 80 Cal.Rptr.2d 126, 131, 133--preponderance of evidence standard applies] For example, property without such easement (or right of ingree and egress) may become landlocked.
