What rights does a tenant have if he or she never signed a contract or lease? It was a common agreement between the two, and now the tenant is threatening to take the landlord to court on issues (that have no merit, but that's beside the point). This is within the state of Arizona. Does this tenant have any legal rights whatsoever? What legal rights does the landlord have? The landlord has other tenants in the same unit that are on contract. The other tenants have not mentioned any interest in this legal battle. This tenant (I believe) has been in the unit for at least a year.

{We do not know, because you didn't, what RIGHTS your referring to here. Therefore, we must assume rights to remain in the unit???}

Does this tenant have any legal rights whatsoever? NONE

What legal rights does the landlord have? PLENTY

Common agreements, expressed verbally, do not bind either party nor are they valid in court.

The other tenants, on contracts or not, are wise to remain neutral.

Best advice is to start packing. It's a case that has no merit and the tenant will lose on every issue and point.
