What is the name of your state (only U.S. law)? NJ
I am have a lease agreement with 2 roommates and they have not paid this past months rent. They are a couple and less than 2 weeks before last months rent was due I was confronted and told that "either you leave or we leave and frankly, we can afford it". I haven't done anything wrong and wasn't given a chance to say anything at all in my own defense. I said "I can get a roommate". 2 days later I was approached with a rental application from them. I told them to leave me alone and not to speak to me unless it was important and that I would let them know when I knew what I was doing and in the meantime they need to pay the rent.
One of them thinks that I owe her money for utilities but I have paid out more than I would owe in shared bills for the apartment. (I realize none of this is relevant but she thinks it is) Two weeks into this past month, before I knew that they hadn't paid their share of the rent they took a vacation to Germany and only returned a few days ago. I had received the notification that rent was not paid by them during their absence. They are rarely if ever here so I called to let them both (roommates) know that I'd left the bill and a note out for them. They did not pay the owed rent and I got only a note asking if I'd found a roommate (shouldn't this be their responsibility?) and if I was going to give them money (I owe them nothing as I've paid more than my share and have made duplicate copies of my paid bills and given them to both roommates) Even if I hadn't paid anything I wouldn't owe anything near what the two thirds of the rent here is.

I would like to add that even if I had found a possible roommate I have no means of showing them the room or bathroom because they have both locked up and the roommates do not answer my calls or questions. I have had to have a third party call even to get the smallest response about important things.

The first of next month is rapidly approaching and I need to know what action I should take. Do I file suit? How do I get them to pay their share. It is not right that they are trying to abandon me in this apartment and I cannot afford to move again - aside from how exhausting and time consuming it is - it is just too expensive for me right now. I can't take any time off of work to look for a place or move and I barely have time to look for a roommate, let alone screen them. I got into this situation believing that I would be paying a third of this rent for a year and now I will be forced to pay half and I am going to be two months late in a matter of days. I just got back on my feet and this is going to put me sleeping on someones couch again. Please help.

I also want to add that we have only been here since the end of January. This decision (someone has to move out) was made by the roommates about 2 months after we'd moved in, around March 20th. I don't agree with it and I do not want to sign them out of the lease agreement. I have barley finished moving in and have just put out all of the usual moving expenses and payed the total amounts on all of the shared bills that were in my name. The claim that the couple "can afford it" is 100% false as one of them was not working full time until March and the other is a full time student that has been using savings until working. I am not sure what the actual issue she has with living with me is as all of her accusations were untrue and irrational. She is also telling people that I stole from her, that is also not true and I have never been confronted with this nor have I received any police investigations. I do not have this information from the "horses mouth" but I thought it might be relevant. I need to protect myself. I pay my rent. I am clean and I am a quiet person to live with. All of this is out of the blue and totally irrational. I have done nothing wrong and nothing to deserve this. Again, please help.:mad:
