What is the name of your state? California.
My friends Mother wants to know hpw she should go about making her son a living trust & how should she go about making him power of attorney for her estate.
Does she gave to go through a lawyer or can she just get the paper work & have them noterized? Can anyone give us any advice?Thank you

It's worth a good attorney

Since everyone's situation is a little different, you should ask an attorney who knows how to create a living trust for advice. Be sure that the attorney really knows the details, though. I have seen a clause in a living trust declared invalid because it was not printed in the correct font size.

If the son is a minor, then there may be some special considerations that only an attorney can answer.

Does she want to give him power of attorney (now) to act on her behalf, or make him personal representative/executor of her estate when she dies? POA is not valid after death.

If she creates a trust, the she needs to make someone the trustee.

So WHAT is it she wants to name her son (presuming he is an adult)?

power of attorney?

executor/PR?

trustee of trust she is creating?
