What is the name of your state (only U.S. law)? NY (Brooklyn)

My mother in-law & her sister are listed on the deed & mortgage to a house in Brooklyn NY. The sister is the borrower on the mortgage with my mother in law as the co-signer. The sister passed away without having a will. Once the mortgage company was notified of the sister's death they stopped accepting payment and will not communicate with my mother in-law. As the co-signer, isn't my mother in-law entitled to assume the mortgage and continue to make the payments?

Depends how the note was worded, but frankly, I am at a loss as to why they wouldn't continue to accept payment. You might need to start rattling up the food chain at the bank.

Note the second issue is who owns the sister's half now. How exactly was the property titled and did the sister have a spouse, children, other siblings....

we were surprised that they stopped accepting payment also! and we were even more surprised when they would not even talk to my mother in-law.
the deceased sister has two children. We helped to get the daughter appointed as "executrix" of the estate. Unfortunately, the children and their mother were not on the best of terms.
we are in the process of obtaining a mortgage to have the property in my mother in-law's name alone and buy out the interest of the heirs.
