Hey Everybody,

I'm in a odd situation and I don't know what I should be doing to get myself out. This started because my girlfriend and her two guy roommates were getting into disputes to the point where me and a bunch of my friends moved her out of her apt on Monday (3/19) to her new place while the guy roommates were not home during the day. To that point, I have always tried to stay out of their conflict and be non confrontational when I talk to the roommates. Well Monday evening I remembered I left my gloves at the old apt so me and a friend decide to swing by to trade my girlfriend's apt keys for my gloves. We got there and I rang the door bell. Justin (roommate 1) answers the door and I ask if I can get my gloves. He immediately says no and slams the door shut on me. He says I cant come in because I'm not on the lease. Me and my friend stand at the door for 3 minutes in disbelief of what just happened. After 3 minutes, Justin and Andrew (roommate 2) open the door. I ask for my gloves and tell them I have the keys for them. They would not give me the gloves. So both sides start to get a little mad but then I said, "you are asking for more trouble than this is really worth" and walk away. When I get outside, I am steaming. I feel like walking over to both their cars and kicking the crap out of them. I walk over, stand for 5 secs, and decided against it (with my friend's help calling me away). I walk to my car and go home.

So..., next day I find out that the roommates wrote an email to my girlfriend's dad saying they filed an incident report with the police. They filed it against me and my girlfriend saying that she sent me over (for what? to get my gloves?) The email said that I was threatening them and they were afraid I was going to do something like hurt their car (btw they are both 2 bigger guys than me). I found out that they were watching through the window when I was standing near their cars and saw me do turn away and walk off.

I'm furious now that they have me on a police report threatening them. My friend who was with me thinks it is totally absurd because I was as non confrontational as I could be. The email also said that if I continue to threaten them they will have to get a restraining order.

What I'm apprehensive about is what implications does this have on me? I'm trying to get a hold of the police report but that might take 10-12 weeks. I have not been contacted by the police or anything. I'm currently a med student right now and I'm just wondering if a hospital does a background check on me, will something like this show up? I tried making a counter-incident report with the police today, trying to tell my version of the story but they wouldn't take it. Is something like a disturbing the peace incident that is not followed up upon going to show up on my record? I don't want to be prejudged by some interviewer for something that did not happen as the record states.

You told him he was asking for trouble. It's not much of a stretch for them to claim they felt threatened by this.

You thought about damaging their cars. You walked over to their cars and stood there contemplating damaging their cars until your good sense kicked in and you walked away. They saw you do this. It's not much of a stretch for them to claim they were afraid you were going to damage their cars.

The police report is not a finding of fact that you threatened them. It's a report that states a cop showed up at their apartment and was told you had threatened them.

The situation may have been absurd, but they were within their rights to call the police for a report. You haven't been arrested, you haven't been charged, you're not required to defend yourself in court. At least not yet. I doubt you will be. If you are, then you can worry about defending yourself. Until that happens, you really don't have anything to defend yourself against.

ETA: By the way, this is not libel, or slander, or defamation.

Thanks for the quick reply, I didnt know what forum this topic would go under. If I'm never arrested, charged or tried, is it still on my record?
