What is the name of your state? Kentucky

Hi. I had a hearing July 25,2005 I have just recieved the decision from the ALJ, and was unfavorable. I read through about 5 or 6 pages. There was a couple of situations stated in the decision that was not exactly the way it was discussed at the hearing. I dont know if the ALJ didnt understand or what. What should I do. I will be filing an appeal with the council. Can you please give me some advice? Thank You Much!! deebishop :(

Kentucky-deebishop--I can help you, as I got a fully favorable decision-on July 08,2005. I also had a judgement from so.sec.for overpayment's before my claim was settled, and they took our tax refund,and they still haven't refunded it back to us. The judge ruled my claim back to May-2000, the overpayment's they stated I owed, were from May-2000-thruSept.-2003. I have a letter from a S.S.employee, that states if you request your benefits continue until your appeals is settled, they will, and if you lose your case, then you have to pay them back. They MUST give you notice before stopping your benefits,etc..I'm still waiting on my backpay of benefits, as the SSA states their computer keeps dumping my information everytime they try to generate my check, I know this isn't true, as I got that proof Sept.23,2005. I'll help you all I can, because the disability and SSI programs were established to help those unable to work with little or no income, not put them and their families through hell, nor drag them thru the mud first. The social security act REQUIRES the SSA to follow their laws and requirements all the time to all claimants,but we're proof they don't, so unless we all stand up and demand they follow this, and treat everyone the same, they don't and they won't. This is paid from our tax dollars, for us if and when we ever need it, and I'm going to do everything in my power to make them follow this act, or else do away with it, one or the other,but not both. If you'll send me your e-mail address I'll attach a copy of the letter's from SSA to you, so you'll have proof to take and show SSA regarding the continuation of benefits until your case is settled.

Did you read her post? Lord, you went babbling on about you.

Poster? As of right now you have your appeal going, so you need to wait that out first.

At this point you should consider a consult w/ an SSI Attorney .

If they think you have a good case , they will represent you .

Why Start from scratch again , It would make it more difficult , and you will be out of DI benefits all that time .

It seemed like My sis had a good case , she was also denied , Consulted a SSI Attorney and Won .

I'm sorry, I guess I didnt give enough info when I started this post. I filed for ssd in Nov. 2003. I have already hired an attorney. I finaly had a hearing July 2005 and I just recieved the ALJ decision a week ago. (unfavorable) The ALJ did not reconize anything that my treating phycisian had to say. He only went with the nuerosurgens records before I was release from him 2002. I fill that this is alittle unfair. Yes my attorney will be appealing the decision as soon as she gives me an appointment to go to her office to go over the decision. Does anyone here have any sugestions on what I should do to help my appeal? Thank You
