My roommate has failed to pay his/her part of the rent. I make more money and am Primary on the lease. Do i have the legal right to remove her from the lease and/or remove her from the property?

No and no.


Not sure what you mean you are primary on the lease. Either you are co-tenants or you aren't. As such, you have no right to take any action against your co-tenant concerning the lease.


If the other person is a sub-tenant with you as their LL, you can evict just like any other LL>
