Hello, I need to know what to tell a creditor,when they call telling you pay or else! o.k. my boyfriend filed bk on this loan company, but i co-signed. i started paying, then I go hard up and couldn't pay. So I didn't pay for a while. It's been about a year since I made a payment. The people started calling again. See I'm waiting to pay until I can get the bf credit report. This same company is in violation of the bk law with him. I also believe they have another, pulling credit report with out permission. Any who~ I want to wait to pay until I get this credit report. B/c if they are in violation like I'm thinking they are the bf is going to use the fine to pay my debt. We applied for an online report but we have to wait 5-7 days b/c they couldn't verify his idenity right then. What can I tell them. They told me friday "you realize you are in the legal dept." Duhh!! I hadn't paid in a year. They said they wanted the payment on "HER desk no later than monday." and her desk is in NJ. Please help, ps I really couldn't afford to pay this week anyway.

I was just asking a question. I was trying to get a legal suggestions from intelligent people. Which obviously isn't from you, since you have to quote a stupid T.V. ad. Here is a little hint, STOP being so obnoxious!!!!!!!!!!!!!!!!

If you and your hillbilly boyfriend were going to do something, you would have done it long ago.

Besides, you don't have the money for litigation - - so, you may as well try some Identity Theft to pay your debts. That's the only way you two are ever going to get any money anyway!

By the way, how's the trailer doing?

We are getting back on track. This company has wrong doing. It's not right for them to threating me, with them have wrong doing themselves. Also this problem has just came up!! or I would have taken care of it sooner. I just don't know why I am explaining myself to YOU anyway!!!!
My TRAILER is fine how about yours ?

What a loser. If you think the "bf" is going to use any money to pay YOUR debts, I've got a septic tank, with your name on it, to sell you. He would undoubtedly use any money he gets on drinkin' rather than spend it on your debts! :D

And, if you REALLY believe you're going to do anything, then you first better check that slow leak in the left trailer tire.

Let's make sure we both understand the situation first. So, you both owed this debt, correct? Your boyfriend filed BK and his obligation to repay the debt was discharged. You still owe the money to the loan company. You paid for a while, but stopped paying. The loan company now wants you to pay the money you owe them.

How have they violated him? Does he have proof? Your failure to pay is a separate issue than their possible violation of his account. They can still call you and pull your report since you still owe them money.

She's probably on a quota system. If she gets your money, she gets a commission or a bonus. If I were you, I'd use caller ID to screen the calls. If you don't answer the phone, you don't have to tell her anything. Of course the loan company can file suit against you which could happen in the near future.

If you think you're going to have to file a bankruptcy, you can file now or wait until the lawsuit is filed and file BK before the scheduled court date. I wouldn't count on the money that the boyfriend thinks he will be getting in the possible violation case since that money may never appear.

:D BTW, did you know you can ignore certain posters? Click on the poster's name and then "view public profile". On that page there will be a link to add the person to your ignore list. All you will see will be the person's name and a message that he/she is on your ignore list whenever that person makes a post.

Yes, it would be interesting to know what violations this collection agency has committed against your BF.

As for you, as the co-signer you know you are liable. Your BF did you no favors on this one, he literally stuck you with the debt. Since this is likely a 3rd party debt collector, then you need to read the Fair Debt Collection Practices Act _ FDCPA and learn what your rights are and what the CA's limitations are. If they are violating the law, then keep a record of the calls and what is said - but you have to know what they CAN'T say or do first.

What can you tell them ? I wouldn't talk to them on the phone at all - its pointless. You can write them a cease and desist letter and tell them they are to contact you by mail ONLY.
