im seperated. a year before our seperation my wife and i were involved in an accident where we both were injured. i required surgery she didnt. the settlement will come in to checks for her injuries and lost wages and mine. Do I legally have to split my settlement with her and vice versa or do we keep our prespective checks?

Are you legally separated or simply not living together?

What will the checks cover? Lost wages? Pain and suffering? Medical expenses? Future wages?

Then it becomes a property division issue if you get divorced. For now, income is marital.

The amounts for hospital bills should be used to pay off the bills, so that's a non-issue. If you choose to put the money into an account instead of paying the bill, then you'll have a credit and a debit which would cancel each other out.

The amounts for past lost wages would be marital and should be split.

The amounts for pain and suffering and future wages (after the date of filing for divorce) COULD be separate and not divided. If, however, the money is put into a joint account, it is mingled and may be harder to separate out.

What are the amounts for each category for each person?
