Hello..I am in Texas. My wife and I have been seperated for 4 years(she left and took our child) She now has a 2nd child and life with another man but refuses to give me a divorce. The home is in both our names and she refuses to let me buy her out or to sell the home and split the proceeds(although she hasnt lived there for 4 years). Is it possible to go to court and have the judge order the house to be sold or do I have to remain married and keep this house with her even though we have both moved on? Also, I have paid the home owners ins. and taxes myself over the years. If she continues to be uncooperative can I ask for 1/2 of these expenses since her name is on the home loan as well? Is there any place I can turn or any hidden loopholes for men out there? Lastly, she is now on probation for criminal mischief for vandalizing my truck(the truck is mine, but in my current girlfriends name..so she actually vandalized HER truck, but it was aimed at me which is why the charges stuck). Would it be prudent to attempt to proceed with the divorce while the probation is in effect..it ends in Dec.

My response:

You should have started divorce proceedings a long time ago. You don't need her signature for anything. You don't need her permission "to give you a divorce".

Where are these "old wive's tales" coming from, anyway ?

Just see a Family Law attorney and file for divorce. You'll get your divorce, and the court will order that the house be divided or sold.

You don't need to wait for her probation to be over. Her criminal requirements and obligations are none of your affair, and have nothing to do with you exercising your rights.
