I was involved in an accident in a parking lot about 3 weeks ago. I only had liability coverage on the car I was driving, and the other driver was insured under the same insuruer. I was driving in the perimiter lane of the lot, and he was using the lot as a cut through to get to another parking lot. The lane he was in ended and he did not stop and proceeded out into my car. We called the police, but he did not assess liabilty in the case. The other driver claimed it was my fault, and I claim it was his. My investigator found me not at fault in his claim against me, but his investigator found us to be contributorily negligent (live in Alabama). The insurace company says that there is nothing they can do. His car suffered only minor damage to the front, but mine is undrivable. Where should I go from here? It works out very well for the insurer because they have 2 insured who had an accident and they didn't have to pay out anything. Should I attempt to file in Small Claims Court. I cannot afford to fix the vehicle on my own at this time. Thanks.
