I know a 24 yr old who had just moved to the area,moved in with his uncle and stayed in a trailer in the back yard with his cousin who is 21 yrs old.his cousin introduced him to a girl who was in his circle of friends.though it was never dicussed, he assumed she was 18.they never dated or saw eachother as more than friends. one night the girl snuck into the trailer in the middle of the night and began fooling around with the 24 yr old. he woke with her on top of him, one thing led to another and they had sex. that was the only time he was with her and sortly after that moved to another town and stopped hanging with that group of friends and found a girlfriend.this made the girl very jealous. two months later the cops showed up at his work but he wasn't there yet, when he arrived at work he went straight to the police dept to see what was wrong. they asked him if he had sex with the girl and he said yes. then they told him she was under age and arrested him. this was the first he knew.she was 15. he said it was obvious that she was not a virgin. there had been a sign posted on the gate stating that you had to be 18 to enter. since then she is hanging around other, older men.this is not a case of a old man taking advantage of a little girl. this is a nice young man and a 15 yr old slut. is there anything he can do to defend hisself or is he screwed. he has a PD, but I know they don't have alot of time. what can he do to help ?

He needs to find out if FL allows the defense that the victim of a statutory rape was apparently over the age of consent. He could also just hope the jury won't convict after hearing all the facts. Her lack of virginity is irrelevant.

He should file trespassing charges against her immediately. This may induce her to drop the charges. If she doesn't, he can sue her (and her parents!) for the intentional torts of trespass & intentional infliction of emotional distress, listing his legal fees and future status as a sex offender as damages.
