I am new to this forum. I recently divorced and in the decree it states that we have to either sell our home or if it forecloses then we will both be responsible for what is owed. I have tried and tried to get my ex to sign paperwork to send into the mortgage company so that I can do a deed in lieu of foreclosure to the VA. The house is in danger of foreclosing any time now. What can I do to save myself? I have done my part, however, he will not cooperate. I have been going through this for over a year now. I moved out May 2005 and he remained in the house until March 2006, I helped pay the mortgage until November 2005 and when it became too much I told him that he could keep the house get it refinanced in his name since he was still living there. He stopped paying also even though he was still living there. He was supposed to bring all of that paperwork for the deed in lieu to the hearing he didn\'t and has not sent it in. I really don\'t want a foreclosure on my credit but I! can\'t afford to make the payments and pay my current bills on top of it all. I would like to buy another house one day and at this rate it doesn\'t seem like that is going to happen anytime in the near future. I wish that I could just make things right with the mortgage company and have it refinanced in my name and just move back in. That would take care of it all. Please help!!

Have you talked to the mortgage company?

Have you tried to qualify for a loan thru a bank?

If they have not started foreclosure yet you have a little time to try and get some things done.

Does you ex still live in the house? If he has moved then you could move back in and start paying the mortgage and talk to the mortgage company about the arrearages getting caught up.

File contempt charges against him and force him to sign the papers. If you move back in then take him to court and force him to sign off on the deed if you can get financed on your own.

Based on your post.... nothing.
Your court order (per your post) says that you sell or foreclose. Your ex is apparently willing to allow the latter to happen.... as is allowed by the order.
