What is the name of your state?tx
I just had my creditors meeting. No one showed up. The trustee said something like "I close this case as no asset case". He did not ask me about my refunds although he is aware that I am expecting it next year. What should I expect of him, will he come after my refunds or just ignore it? Also will I get any letter from the trustee or court about our hearing and truetee's decision?

At our 341 meeting we had to sign a form stating that we were aware that the trustee had a right to our 2002 & 2003 refunds if we had not already received them. There was nothing on the paper stating anything about our 2004 refund (meeting was held in late July).

Since you just had your 341 meeting, you should probably expect the Trustee to ask for your refund for 2004.

After the 341 meeting your creditors have 90 days to object. If no objections are filed you should receive your discharge shortly after that. Our 341 meeting was held on 7/21/04 and we are to be discharged today 10/08/04 according to the court's automated phone system.

I would expect that we should see our discharge paperwork in the mail soon.

Nope. After the 341 meeting creditors have 60 days to object. In there are no objections, and the Trustee doesn't file for an extension, then your discharge papers should come to you shortly after day 61.

As for what happens now - you wait. You will likely get a letter from the Trustee stating that he's 'abandoning' the estate - which means there's nothing for him to take to sell to pay creditors. If he wants your refund, you will be notified.

I wasn't notified when the Trustee kept my Federal tax refund the first year of my chapter 13. I didn't receive my refund for several months so I contacted the IRS and they pointed me to the Trustee. I contacted my Attorney and he contacted the Trustee and requested release of the refund. My Trustee mailed it to me within a week, after he confirmed I was on a 100% plan and I wasn't behind on any of my Trustee payments. My Attorney told me the Trustee would have kept it (or a portion of it) if I was on a "less than 100% plan" or I was late on any Trustee payments. The Trustee intercepted my returns during the following two years and provided them to me within 2 weeks of receiving them (after confirming I wasn't late on any Trustee payments).

So there is a chance that my next years refunds might not be 100% mine. Should I change my tax withholding so that less tax is withheld out of my paycheck, now that 341 meeting is over?
