My mother was rear ended while stopped at an intersection red light. the vehicle she was driving was her employer's. She was taken to the e.r. and thereafter sought treatment from a chiropractor. Her attorney recently sent her a settlement authorization in the amount of $10,000.00. It states that their legagl fees as well as the medical bill totaling $5,530.00 will be taken from this settlement amount. This just didn't sound fair for my mom who was the one hospitalized and suffered. She'll end up with roughly $1,100!!! Is this right? If not what is fair? Shouldn't the medical bills be paid directly by the insurance of who caused the accident? If not ask for at least 3 times the amount of the medical bill? How does this all work? Please advise us... we don't seek more than what is due to my mom but if my calculations are correct, she'll only recieve roughly$1,100. Is that fair?

looks like the lawyer wants to get his cut and run-talk to another lawyer before she signs settlement and make sure and discuss with atty.what your expectations are and what you'll accept as reasonable compensation

I would suggest you talk to the attorney and ask if he is going to try and compromise the medical bills. Most medical facilities that work on a lien basis are agreeable to reducing their billed amount if a case settles for a small amount.
