What is the name of your state? Ca

I am in a situation where I had to take my children and live in a domestic violence shelter because my husband was threatening my life. I was granted a TRO and now I have a hearing on Thursday for my order to show cause/PRO hearing. What evidence do I need to bring to get this granted? What do I say? Now that I am no longer in the Shelter, I don't have people around for support that have been through this. Thanks so much.

You could bring the tape recording you made of his statements and threats to court with you.

IAAL- I don't have any tape recordings of his threats. Is there anything else I can do to make sure I win my case? We had court on 5/12 and he got it continued because he said he is bring 4 witnesses and an attorney who he needed to prepare his case with. I can't afford an attorney and have NO idea how this works at all. The manager of the women's shelter that I was at told me that all I have to do is show up and I'll win, but I want to be prepared to fight for myself and my children, since he has armored up with witnesses and an attorney. I do have a friend who now lives out of state that witnesses threats and abuse, but other than that he was very careful to hide the abuse and so was I. Thanks!

Any chance you could get your friend back there to testify?

If a police report was filed against him for an assault against you, see if you can obtain copies of these reports. Also, if you are the victim of a violent crime you have a right to services provided by your local Victim/Witness advocate - this person is likely available through the courts or your local social services agency.

If there are no police reports or witnesses, you may have a tougher time obtaining the TRO.

Make sure you file any police reports with the court. Obtain an affidavit/declaration from the DV shelter.
