What is the name of your state? Nevada. My brain damaged brother is coming to live with me & my husband. He is 51 years old and had been in a serious accident when he was 23 and my now 84 year old dad has been taking care of him but my dad can no longer properly care for him They have been living in another state but my borhter is coming here to Nv. I will be his primary care giver and I know that there are a lot of legal questions that have to be answered but I am not quite sure which kind of attorney I should see. He has been collecting disability all these years and of course my dad has been handling all of that, but now I will be and I really need some expert advice. I appreciate any and all!!!!

They will have many brain injury related services including resources for caregivers which may include legal services.

You will need to become the representitive payee for social security as well, whether or not you become guardian or conservator may be optional depending on his competency. There is a lot to learn and will require patience.

In addition to the other good advice you received from the other posters, if you are going to petition to be your brother's guardian, you will require a NV primary care physician's report. The resources rmet mentioned are good sources to call and obtain referrals. You will also need copies of any POAs or any guardian/conservator papers that your father may have. Remember to 1) petition to be your brother's Health Care Surrogate. One can be a legal guardian/conservator and not be the Health Care Surrogate and 2) should the issue of you posting a bond arise, ask for a "depository" account. Depository accounts can only accessed via a court order. An attorney will be able to assist you with all this.

The following two websites are extremely useful for supplies and other devises that will assist you with care of your brother. They are www.dynamic-living.com and request a catalog from www.cresthealthcare.com as there's much more available in the catalog than on the website. Lastly, do contact sources and organizations in your area and develop good support relationships with others.
