What is the name of your state? oregon
i own my own home, im single age 42 no kids no ex wife. the only living relatives are my mother and my brother. i have a girlfriend. i dont have a will. who or what would happen to my home if i died who would get my home, my brother, mom girlfriend, or the state??

My response:

First, if you made a simple Will, you wouldn't be asking this question, and wondering who'd be getting your "stuff" after you're dead.

Second, the "State", like every State, has laws that will "decide" for you who get's what, if anything. Now, if you want the State laws to decide, then continue as you are, and cause some grief among those who love you.

Third, the only time the "State" takes anything from an Estate is when there's no one left to make a claim. That's called "Escheating to the State".

But, as a final note, without a Will, I can tell you right now who's NOT going to get anything - - that's your girlfriend. So, unless you make a Will, and let's assume that you want her to continue living in the house after you're gone, she WON'T be able to IF you allow the State to use it's laws. So, have a simple Will drawn up, and give the things you want to whomever you want. It will be your last decision - - but, at least it will be YOURS, and not the State's.

thanks for the info . i got a will made up and left everything to my girlfriend. i feel good that all is safe now. thank you very much.
