What would qualify me as the landlord? Or co-landlord?

Technically, I've been managing a rental with my boyfriend (the legal owner). We've made all decisions together. Now, we are having to evict our tenant. Neill works full time, while I stay at home. It's more convenient to have me go to court and handle the eviction.

When it was rented, his name was put on the lease as the landlord. If my name were on the title of the townhouse, could I legally be considered the landlord? Or could I only be considered the landlord if my name were on the rental lease?

Would there be anything else that might qualify me as the landlord, in the eyes of the court system? Any kind of power of attorney or agreement?

Good question.
Someone might know this answer off the top of their head Monica, I am sure you are going to be doing more research as well as you get the paperwork ready. It might be worth it for him to take the day off work, and have his name be the one that files.

But One thing I want you to make sure you do is get every name right on the unlawful detainer. The California courts are a stickler when it comes to that. The even added an appendix for "unamed people" for the writ of possession.

California Civil Code Section 1962: (a) Any owner of a dwelling structure specified in Section 1961 or a party signing a rental agreement or lease on behalf of the owner shall do all of the following: (1) Disclose therein the name, telephone number, and usual street address at which personal service may be effected of each person who is: (A) Authorized to manage the premises. (B) An owner of the premises or a person who is authorized to act for and on behalf of the owner for the purpose of service of process and for the purpose of receiving and receipting for all notices and demands. (2) Disclose therein the name, telephone number, and address of the person or entity to whom rent payments shall be made.
Sorry no paragraphs, but that is how it is written in the statutes. I am not sure if it applys. Just trying to help... Okay Orange juice for the sickie... gotta go.

One thing that has worked up where I live and your county clerk of the court can tell you if it will be acceptable there as well is if your BF can give you a letter that has been stamped by a notary that grants you limited power of atty to represent his interest in the eviction matter with ( tenant names ) for the next say 90 to 120 days . If the clerk of the court tells you that is acceptable then you should be able to get it done with no problem .
