I was at the designated meeting place for my 2 hours of visitation, on my younger sons birthday. Mom no showed me. I sent an email asking if something happened, she emailed a picture of a custody draft showing that I was supposed to pick up my children at her home. I explained in reply that her attached picture was a draft, I explained the certified copy stated that her requested place of exchange was the only listed place of exchange. I attached photos of the certified page with the proper file stamp, to indicate I was being accurate.
I honestly thought this was a reasonable mistake on her part.

When I got my children 3 days later they explained they were at their grandmothers house (4 hour drive) on that day and that, their grandmother was telling their mother she should not keep the kids from me.

I have had visitation difficulty with my ex-wife for about 18 months. But I've been divorced over 6 years. Her new husband is a bully and I assume he encourages most of this, I still find her responsible but for 5 years she allowed me to have my kids when ever I wanted which was most of the time.

In summary, she denied me visitation in March of 2010, that escalation of events led to me gaining custody of my two sons 12 &14, and a lot of hassle from the ex-wife.
In that cornucopia of legal fillings was a motion to enforce with 21 counts of visitation violations, and none of them were petty.
In receiving custody I was asked to allow the dismissal of the visitation violations with prejudice, My attorney said it was a good deal. I asked what if I get more visitation issues, he told me then the past violations could be brought back even though they were dismissed with prejudice.

It is my desire to get in a place where we can just get along. I find her blatantly disregarding my sons birthday as just being difficult for no real reason. Had she sent an email asking to take the kids out of town on my sons birthday I would have agreed and asked for make up time.

So what would you do?
take the legal route? time, money, stress
let it slide? hoping she eventually gets over being difficult

You may be past that point.


What would I do? I'd have my attorney write her a very strongly worded letter stating that if she ever denies me even one minute of visitation that I'll take her to court for contempt. If she continues after that, I'd be asking the court for custody.

But what YOU do is entirely up to you. None of us knows your ex or how she is likely to respond to the different options you have.
