Here's mine and my friends issue. We worked for this company(do not wish to include name) and were managers. Both of us had personal issues and therefore decided to leave for the time being to straighten our lives. Now before we left we reviewed all policy and procedures and got confirmation from corporate office that we were eligible for re-hire as long as we work out our proper notice with our General Manager which we did. The day after we had put in our 2 weeks notice our G.M. put his in stating he was going to another location in the area. About a week or so after we were done working for the company we got a call asking if we were interested in coming back to his new place asking if our issues were sorted. We decided that we were going to try. Now the catch is that upon reading the places handbook and procedures stating that a re-hire has directly to do with Human Resources and the General Manager of the business and having correct confirmation we were eligible for re-hire the District Manager is denying us this right. This District Manager is someone whom we have very vaguly met, and do not know personally nor understand his position, but we do know we followed all policy and procedures and have nothing against us. I feel and almost know that he is doing this because him and his General Manager did not get along and he knows we get along great and have awesome respect for the GM, and the new place of business is hiring for management positions where he simply told us in an e-mail that our services were no longer needed. I feel as well as my friend that we are unfairly being discriminated against where he has not given us any logical reasoning why we cannot be re-hired except stating he will not. Myself and my friend have moved to the next step in chain of command and moved on to opening a Human Resource Investigation for unfair discrimination without probable cause infringing with our rights.

You have absolutely no "right" to be rehired. An employer marking an employee's file "eligible for rehire" when they leave in no way obligates an employer to rehire that individual should he reapply.

I feel as well as my friend that we are unfairly being discriminated against where he has not given us any logical reasoning why we cannot be re-hired except stating he will not. He has no obligation to provide you with an explanation as to why he doesn't wish to hire you.

Myself and my friend have moved to the next step in chain of command and moved on to opening a Human Resource Investigation for unfair discrimination without probable cause infringing with our rights. That is all legal gobbeldy-gook. Nothing in your post remotely suggests you have any legal claim against this employer.
