I recenty moved from Califonia to Utah with an agreement with a landlord to rent to own a home. At the time Ihad visited the home there were tenants still living in the home, so I was unable to view the entire house. When I contacted the owner he claimed he was doing some work to the house and it would be ready to live in by the weekend of the 6th of October. He had asked for a substantial deposit plus the first months rent, which we sent right away. We felt the landlord was being honest and upfront with us about the house. Until the day we arrived. We didn't move out until octber 14th and when we did arrived the house smelled of urine and feces. In our opinion the home was in unlivable condition. Upon further discussion with some of the neighbors, we were informed the former tenants didn't actually leave until three days before we arrived. We decided not to take the home and were forced to put our belongings into storage and live in my parents motorhome, while we looked for other places to live. The landlord retuned our deposti, but kept our first months rent. We feel that we are owed atleast the rent back, because he didn't live up to the agreement. We are thinking of taking him to small claims court to get the rent plus extra moneys we had to put out due to the inconvience. Do we have a case to pursue?
