The NJ transit employee was not acting in his official capacity (part of his job duties) when he burned the koran three days ago near ground zero. Nevertheless, his employer fired him because actions performed in his individual capacity (off duty and not wearing his uniform and not promoting his name or employer) still was deemed to be an ethical violation of NJTransit policies.

But all in all, I agree with cbg.
